Purpose and Activity

MiTaller.art is an intermediation platform (marketplace) that connects Menorcan creators with buyers. The owner of this website acts solely as a technological intermediary, facilitating the connection between creators and customers. Creators registered on the platform are responsible for their own products, descriptions, prices, shipments and compliance with their tax and legal obligations.

Intellectual Property

The contents of this website (texts, design, code, logos) are the property of the owner or the creators who have contributed them. Their reproduction without express authorization is prohibited. Product images and descriptions are the property of each creator.

Limitation of Liability

The owner is not responsible for:

• The quality, safety or legality of products sold by creators
• The fulfillment of transactions between creators and buyers
• Content published by creators on their profiles

Terms of Use

1. Purpose

These terms regulate the use of MiTaller.art, a marketplace connecting Menorcan creators with buyers.

2. Definitions

• Platform: MiTaller.art
• Owner: Marcel Reig Ibarra
• Creator: Registered user who sells products
• Buyer: Person who purchases products (no registration required)

3. How the Marketplace Works

MiTaller.art acts as an intermediary. Purchase contracts are established directly between creators and buyers. The platform owner is not a party to these transactions.

4. Creator Registration

To sell on the platform, creators must:

• Register with truthful information
• Complete their profile (photo and description)
• Upload at least 1 product
• Be approved by the MiTaller.art team

The owner reserves the right to approve, reject or remove creators who do not meet the quality standards or these conditions.

5. Products

Creators are responsible for:

• The accuracy of descriptions and images
• The quality and safety of their products
• Compliance with applicable regulations
• Their tax obligations (invoices, VAT, business tax)

It is prohibited to sell products that are not of own artisanal production or that infringe third-party rights.

6. Prices and Payments

• Prices are set by each creator and include VAT if applicable
• Payments are processed through Stripe
• The creator receives the amount minus the platform commission
• Current commission: 5% (Pro plan) or 8% (Basic plan)

7. Shipping

• Each creator sets their shipping costs and delivery zones
• The creator is responsible for shipping and delivery
• Some creators offer workshop pickup

8. Returns

Returns are handled directly between buyer and creator. We recommend that each creator indicates their return policy on their profile. The platform owner may mediate in case of conflict, but final responsibility lies with the creator.

9. Owner's Responsibility

The owner of MiTaller.art:

• Provides the technological infrastructure
• Processes payments securely through Stripe
• Reviews creators before approving them

The owner is NOT responsible for:

• Quality or defects of products
• Creator non-compliance
• Shipping delays or losses
• Disputes between creators and buyers

10. Intellectual Property

• The platform and its code are property of the owner
• Product images and content are property of each creator
• By uploading content, creators grant a license to display it on the platform

11. Modifications

The owner may modify these terms by notifying registered users. Continued use of the platform implies acceptance of the changes.

12. Cancellation

• Creators can request cancellation by emailing hola@mitaller.art
• The owner may suspend accounts that violate these terms
• Pending orders must be completed before effective cancellation

13. Applicable Law

These terms are governed by Spanish law. For disputes, the parties submit to the courts of the Balearic Islands.
